1. Acceptance of these terms
By selecting “Accept and continue,” using this website, or submitting a form, you confirm that you have read and agree to these Terms of Use and acknowledge the Privacy Policy and Privacy & Cookie Notice. If you do not agree, do not use the website or submit information. This website provides general information about SiteSmith services, and nothing on the public website alone creates a client relationship or requires SiteSmith to accept a project.
2. Quotes and project agreements
Displayed prices are starting estimates, not binding offers. Final scope, price, schedule, payment terms, ownership, revisions, cancellation rights, and deliverables will be stated in a separate written proposal or project agreement. That signed agreement controls if it conflicts with this website.
3. Design Approval Promise
SiteSmith will keep refining the initial design direction until the client approves it, provided the requested refinements remain within the original agreed project scope and the client supplies timely, specific feedback. After design approval or the start of full development, additional revisions are governed by the revision allowance and change terms in the project agreement. This promise does not include unlimited scope changes, entirely new concepts after approval, or work outside the agreed project.
4. Website Care plans
Website Care is available for eligible SiteSmith-built websites. Starter, Standard, Ecommerce, and Custom website projects include Essential Care for the first three months after launch; the Personal One-Page Site and standalone add-ons do not include this offer. During the included period, a client may upgrade to Priority Care for $99 per month. At the end of the included period, paid care does not begin or continue unless the client approves it. Standalone paid care plans begin with a three-month commitment and then continue month to month. Both plans cover one standard domain registration or renewal while the plan is active, plus connection and ongoing setup support for that domain. The domain should be registered in the client’s name whenever possible and remains the client’s. Premium, aftermarket, brokered, transferred, or specially priced domains require a separate written quote. Essential Care is otherwise $39 per month and includes one small update request; changes to text, photos, prices, business details, or links; a manual form, link, and contact-detail review; republishing approved changes; versioned updates with rollback support; and an email response within two business days. Priority Care is otherwise $150 per month and includes the Essential services plus up to four small content or design update requests, small layout and section improvements, basic on-page SEO, manual form, link, mobile-layout, and accessibility checks, and an email response within one business day. Each request covers one clearly defined small change, and unused requests do not roll over. Larger changes, new pages, redesigns, new features, external hosting, advanced analytics, ecommerce or point-of-sale systems, continuous monitoring, automatic backups, storage, and paid third-party tools are not included unless separately confirmed and quoted. Exact scope, billing, cancellation timing, domain access, and exceptions will be stated in the care agreement. SiteSmith cannot guarantee the uninterrupted availability of outside platforms or services.
5. Automated help chat
SiteSmith Help is a free rule-based assistant with preset responses, not an artificial-intelligence model or a person. Its answers are general website information and may be incomplete or outdated. They are not a binding quote, promise, professional advice, or replacement for a written project agreement. Before starting a chat, you must agree that the full transcript will be emailed to SiteSmith and may be reviewed by a person for customer support, service research, and improvement. Do not submit sensitive information through the chat.
6. No guaranteed business results
SiteSmith aims to create professional, useful websites, but does not guarantee specific sales, leads, search rankings, traffic, revenue, or other business outcomes. Results depend on many factors outside SiteSmith’s control.
7. Referral program
A referral must be a new SiteSmith lead, provided with permission, and not already in active conversation with SiteSmith. After the referred client signs an agreement and SiteSmith receives the first required project payment, the referred client receives one $100 credit toward that eligible project and the referrer receives one $100 credit toward a future eligible SiteSmith service. Referral credits are not cash, are not transferable, and cannot be redeemed for cash. Self-referrals, duplicates, spam, and fraudulent referrals are not eligible. SiteSmith may change or end the program for future referrals.
8. Intellectual property
The SiteSmith name, branding, website design, text, and original materials on this website may not be copied, republished, or used commercially without permission. Client-project ownership is governed by the applicable project agreement.
9. Third-party services and links
This website may link to client websites, social networks, form processors, email providers, and other third parties. SiteSmith does not control their availability, content, privacy practices, or security and is not responsible for third-party services.
10. Acceptable use
You may not misuse forms or chats, submit unlawful or deceptive information, attempt unauthorized access, disrupt the website, introduce malicious code, impersonate another person, or use the site to violate another party’s rights.
11. Disclaimer and limitation
The website is provided on an “as available” basis. To the extent permitted by law, SiteSmith disclaims implied warranties related to this public website and will not be liable for indirect, incidental, special, or consequential losses arising from use of the website. Some jurisdictions may not allow every limitation, so applicable rights may vary.
